1. Acceptance of Terms

By accessing and using Smart School, you accept and agree to be bound by the terms and provisions of this agreement. These Terms constitute a legally binding agreement between you and Smart School regarding your use of our services.

If you are using our services on behalf of an organization (such as a school or educational institution), you represent that you have the authority to bind that organization to these Terms.

2. Service Description

Smart School provides a comprehensive school management system designed for educational institutions. Our services include but are not limited to:

Student and staff management systems
Academic and administrative tools
Communication and notification features
Reporting and analytics capabilities
Mobile applications and web interfaces

3. Use License

Subject to these Terms, Smart School grants you a limited, non-exclusive, non-transferable, and revocable license to use our services for your educational and administrative purposes.

Permitted Uses

Managing school operations and administrative tasks
Tracking student progress and academic records
Facilitating communication between staff and parents
Generating reports and analytics for educational purposes

Restricted Uses

Commercial exploitation of our services
Reverse engineering or attempting to extract source code
Using services for illegal or unauthorized purposes
Interfering with or disrupting service functionality

4. User Accounts and Registration

To access certain features of our services, you may be required to create an account. You are responsible for:

Providing accurate and complete information during registration
Maintaining the security and confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use
Ensuring your account information remains current and accurate

5. User Responsibilities and Conduct

When using our services, you agree to:

Use services only for lawful and educational purposes
Respect the privacy and rights of other users
Not upload or transmit harmful, offensive, or inappropriate content
Comply with all applicable laws and regulations
Maintain appropriate security measures for your data
Report any security vulnerabilities or concerns

6. Data, Privacy and Data Retention

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

You are responsible for ensuring that you have the necessary permissions to share any personal information (including student data) through our services, and for complying with applicable data protection laws.

Data retention if a plan lapses

We do not delete your data the moment a trial ends or a plan is not renewed. If your 30-day free trial ends, or a paid plan lapses, and you do not activate or renew a plan, your account continues to exist and your data is retained for a period of at least 24 months (2 years) from the date the trial ended or the plan lapsed. During this retention period:

Your data (students, classes, homework, notices, attachments and settings) is preserved.
You may reactivate at any time by activating a plan and pick up exactly where you left off.
Your account may operate with reduced (Basic-tier) limits until you activate a plan, but you are not locked out of your existing data.

After 24 months of continuous non-renewal or inactivity, we may permanently delete the account and its data. We will make a reasonable effort to give you at least 30 days' prior notice by email to your registered address before any such deletion, so you can reactivate or export your data. You may also request earlier deletion of your data at any time by contacting us.

7. Service Availability and Maintenance

We strive to maintain high availability of our services but do not guarantee uninterrupted access. Our services may be temporarily unavailable due to:

Scheduled maintenance and updates
Technical issues or system failures
Network connectivity problems
Force majeure events beyond our control

We will provide reasonable notice for scheduled maintenance and work to minimize service disruptions.

8. Intellectual Property Rights

Our services and their content, including but not limited to software, text, graphics, logos, and design, are owned by Smart School and are protected by intellectual property laws.

You retain ownership of any content you create or upload using our services, but you grant us a license to use, store, and display such content as necessary to provide our services.

9. Limitation of Liability

To the maximum extent permitted by law, Smart School shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Loss of profits, data, or business opportunities
Service interruptions or data loss
Damages resulting from third-party actions
Any other damages arising from your use of our services

Our total liability to you for any claims arising from these Terms or your use of our services shall not exceed the amount you paid for our services in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Smart School, its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of our services or violation of these Terms.

11. Termination

These Terms remain in effect until terminated. We may terminate or suspend your access to our services immediately, without prior notice, for any reason, including:

Violation of these Terms
Fraudulent or illegal activities
Non-payment of fees (if applicable)
Extended periods of inactivity

Upon termination, your right to use our services will cease immediately, and we may delete your account and data in accordance with the data retention policy set out in Section 6. Note that simply letting a trial or plan lapse is not a termination: in that case your data is retained for at least 24 months as described in Section 6, and you can reactivate at any time.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of our services shall be resolved through good faith negotiations. If such negotiations fail, disputes may be resolved through appropriate legal proceedings.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and updating the "Last updated" date above. Your continued use of our services after such changes constitutes acceptance of the new Terms.
